1. Scope of the Warranty
This warranty applies to the services provided by Blue Collar Experts ("Contractor") for any repairs, installations, or improvements performed on the property of the customer ("Client"). The warranty covers defects or failures in workmanship or structural integrity of the services provided, subject to the exclusions outlined below.
This warranty specifically covers the following:
Workmanship: Ensuring that services performed meet industry standards and are defect-free under normal use.
Structural Integrity: Guaranteeing the work does not fail due to defects in materials or poor construction.
Material Defects: If materials fail due to defects in manufacturing, the warranty includes coverage for replacing or repairing such materials.
2. Warranty Coverage
Workmanship Guarantee:
The Contractor guarantees that all work will be performed in a professional manner and in accordance with agreed-upon specifications. If defects or failures occur due to poor workmanship, the Contractor will repair or correct the issue at no additional cost to the Client.
Structural Integrity:
For structural work such as foundations, framing, and load-bearing elements, the Contractor guarantees that the work will remain sound and free from defect under normal conditions for the duration of the warranty period.
Materials Guarantee:
The warranty covers defects in materials supplied by the Contractor if such defects arise due to manufacturing issues. This includes replacing or repairing materials found to be faulty during the warranty period. The warranty period for materials will be governed by the manufacturer’s guarantee, and if applicable, Blue Collar Experts will work with the manufacturer to replace or repair faulty materials.
3. Warranty Period
Standard Warranty Period: The standard warranty period for all services performed by Blue Collar Experts is one year from the date of completion.
Extended Warranty: For certain types of work, including structural repairs, foundational work, and major installations, the warranty may be extended to nine years or longer depending on the terms agreed upon in the contract.
Preventive Measures for Extended Warranty: The warranty may be extended if the Client opts for preventive treatments or maintenance at the time of installation. Examples include:
Fence and Deck Sealers: Clients who purchase sealing as part of their deck or fence installation will receive an additional 9-year warranty extension.
Moisture-Proofing and Coatings: Selecting moisture-proof coatings for exterior elements (e.g., decks, basements, foundations) may result in extended warranties on structural and material integrity.
4. Exclusions from Warranty Coverage
This warranty does not cover:
Normal Wear and Tear: Over time, all materials undergo natural aging and weathering, which is not considered a defect. This includes fading paint, wood shrinkage, or rusting of metals.
Improper Maintenance: If the Client fails to perform recommended maintenance (such as re-sealing wood decks or fences), any resulting damage will not be covered under warranty. Maintenance guidelines will be provided in writing at the completion of the project.
Abuse or Misuse: The warranty does not cover damage caused by improper use, abuse, neglect, or accidents (e.g., a vehicle running into a fence or a deck being overloaded).
Modifications: Any damage caused by modifications or alterations made to the work by the Client or any third party after project completion, including changes that affect the integrity of the structure.
Acts of Nature: Damage caused by acts of nature, such as floods, storms, earthquakes, and other natural disasters, is not covered by the warranty. Clients are encouraged to check local building codes and weather-related risks when planning installations in sensitive areas.
Third-Party Interference: The warranty excludes damage caused by contractors, services, or individuals not employed or directly contracted by Blue Collar Experts.
5. Maintenance Guidelines
For warranty coverage to remain valid, Clients must follow Blue Collar Experts’ recommended maintenance guidelines. These guidelines will be provided in writing at the completion of the project and will vary depending on the type of work performed. Failure to adhere to the recommended maintenance procedures may void parts of the warranty.
Examples of recommended maintenance include:
Reapplying sealers, paints, or protective coatings at regular intervals (annually or as specified).
Keeping drainage pathways clear and free from obstructions to avoid water damage.
Avoiding harsh chemicals or improper cleaning methods that could damage the materials.
6. Claim Process
To initiate a warranty claim, please follow these steps:
Notification: The Client must notify Blue Collar Experts in writing within 30 days after discovering a defect. Written notification should include a detailed description of the issue, photographs, and any other supporting information.
Inspection: After receiving the notification, the Contractor will schedule an inspection within 14 business days to assess the problem and determine whether it falls within the warranty coverage.
Resolution: If the issue is covered by the warranty, the Contractor will take corrective action at no additional cost to the Client. This may include repairing, replacing, or remediating the problem depending on the nature of the defect.
Exclusions: If the issue is not covered under warranty, the Contractor will provide a written explanation and an estimate for any necessary repairs or replacements.
7. Limitation of Liability
Blue Collar Experts is responsible solely for the repair or replacement of defective work or materials. The Contractor’s liability does not extend to any incidental or consequential damages, including but not limited to property damage, lost profits, or costs related to downtime or inconvenience.
8. Warranty Transferability
This warranty is non-transferable and applies solely to the original Client who contracted the services. If the property is sold or transferred to a new owner, the warranty will be void unless otherwise agreed upon in writing by Blue Collar Experts. In cases where a new homeowner desires to transfer the warranty, a transfer fee and approval process may apply.
9. Extended Warranty Options
While our standard warranty period is one year, Blue Collar Experts offers optional extended warranties for select services and installations. If you wish to extend your warranty, please inquire at the time of contract negotiation. Additional coverage can be applied to areas like:
Roofing and Waterproofing: Additional coverage against leaks.
Deck and Fence Sealing: Extending the life of your fence or deck with premium sealing treatments.
10. Goodwill and Client Satisfaction
Although the formal warranty period is one year (or as specified), Blue Collar Experts values long-term relationships with our clients. We are committed to your satisfaction and, at our discretion, may offer goodwill services beyond the formal warranty period for issues that are not covered but arise due to unusual circumstances or our oversight.
11. Dispute Resolution
In the event of any disagreement regarding the application of this warranty, both the Contractor and the Client agree to first attempt to resolve the issue through amicable negotiation. If a resolution cannot be reached, the dispute will be subject to mediation or arbitration as outlined in the service contract.
